Please read this terms of service agreement in full before using this website or ordering from Yepkit. By using this website or ordering from Yepkit you agree to these terms unconditionally. If you do not agree with or accept these terms of service, do not use this website or order from Yepkit.
Yepkit accepts returns for unopened products and kits, within 14 calendar days from the date of receipt. After this 30 calendar days period, requests for return will be considered but are not guaranteed to be accepted. Return shipment and associated costs is the responsibility of the customer. All return shipments must include a return reference code that will be provided by Yepkit upon the customer contact and after the return eligibility is verified.
We accept payments through PayPal and Credit Cards. The amount of the order is charged in full immediately after the user order confirmation action at the end of the checkout process, using the method selected by the customer during checkout. After successful payment the customer will receive an email with the order reception and payment confirmation along with the order details. The invoice will be available, on dispatch of the order to the customer, in the "My Account" page in the "Orders" section. All orders details, including billing details, are always accessible and visible in the "My Account" page in the "Orders" section.
The customer has the right to withdraw from a purchase from us within 14 calendar days. However, if this period expires on a non-working day, the deadline is extended till the next working day. Note that the returned goods may not have been used. Please refer to the Returning Purchased Items point of the present Terms of Service. If the customer withdraws from the purchase, and complies with the stated conditions, we shall reimburse the order value excluding non standard shipping costs. We will carry out such reimbursement using the same means of payment as the customer used for the initial transaction. This reimbursement will be performed within 14 days of the withdraw notification as long as the goods have already been received back by us or we have received evidence that the customer has sent them back to us. The customer must send the goods back to us within 14 days of the withdraw notification. To exercise the right of withdrawal, the customer must notify us of the decision to withdraw from the purchase by an unequivocal statement (e.g., a letter sent by post or email). The customer may also use the process for returns detailed in the shipping and returns page.
Delivery time changes depending on destination Country, but generally 3/5 days for Europe and 5/7 days for outside Europe. Yepkit cannot be hold responsible for the Carriers late deliveries. Once the goods have been shipped, the customer will receive a shipping confirmation email. Time requirements are meant in working days only, Monday to Friday, national holidays excluded, and in any case not during nor including the company annual leave period which will be communicated in good time on the website homepage. Orders are accepted same day if placed before 5pm GMT. The customer is responsible for any VAT, tariff, duty, taxes, handling fees, brokerage charges, customs clearance charges and charges required by your country for importing consumer goods. When an order is placed with Yepkit, it will be shipped to an address designated by the purchaser/customer as long as that shipping address is compliant with the shipping restrictions contained on this website and with Portuguese law. All purchases from this website are made pursuant to a shipment contract. As a result, the risk of loss and title for items purchased from this website and/or from Yepkit pass to you upon delivery of the items to the carrier unless otherwise specified in writing by Yepkit. The customer is responsible for contacting Yepkit directly to initiate any claim for damaged and/or lost shipments. The customer is responsible for paying any import duties and taxes on the order.
Yepkit warrants that its products will conform to the specifications. This limited warranty lasts for one (1) year from the date of the sale. The purchase invoice serves as proof the start of the warranty period. Yepkit shall not be liable for any defects that are caused by neglect, misuse or mistreatment by the customer, including improper installation or testing, or for any products that have been altered or modified in any way by a customer. Moreover, Yepkit shall not be liable for any defects that result from customer's design, specifications or instructions for such products. Testing and other quality control techniques are used to the extent Yepkit deems necessary.
If any Yepkit product fail to conform to the warranty set forth above, Yepkit sole liability and customer or user's exclusive remedy shall be to have such products replaced. Yepkit reserves the right to use a cash return as the remedy instead of product replacement. Yepkit liability shall be limited to products that are determined by Yepkit not to conform to such warranty. If Yepkit elects to replace such products, Yepkit shall have a reasonable time to deliver replacements. Replaced products shall be warranted for a new limited warranty period. Except for the above limited warranty, Yepkit and/or its respective manufacturers and distributors, to the maximum extent permitted by law make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on its website for any purpose. Except for the above limited warranty, all such information, software, products, services and related graphics are provided "as is" "with all faults," and without warranty of any kind, whether express, contractual, or statutory. Except for the above limited warranty, Yepkit and/or its respective manufacturers and distributors hereby disclaim to the maximum extent permitted by law all warranties and conditions with regard to proposal, specification, sample, information, software, products, services and related graphics, including, but not limited, all implied warranties and conditions of merchant-ability, fitness for a particular purpose, title, lack of virus, accuracy or completeness of response, quiet enjoyment, quiet possession, correspondence to description and liability for infringement of any proprietary rights, relating to use of information in any documents and files and software and no license, express or implied, by Yepkit or otherwise, to any intellectual property rights is granted herein. Yepkit assumes no responsibility or liability for any errors or inaccuracies that may appear in any documentation or files or any software that may be provided. The information in any documents or files is furnished for informational use only, is subject to change without notice, and should not be construed as a commitment by Yepkit, manufacturers and distributors. The entire risk arising out of use or performance of the product and any support services remains with you. The above limitations may not apply to you. However any warranty, whether express, contractual, or statutory, or imposed by applicable law shall be limited to one (1) year from the date of sale.
The customer agrees that prior to using any systems that include Yepkit products, customer will test such systems and the functionality of the products as used in such systems. Yepkit may provide limited technical, applications or design advice, quality characterization, reliability data or other services. Customer acknowledges and agrees that providing these limited services shall not expand or otherwise alter Yepkit limited warranties, as set forth above, and no additional obligations or liabilities shall arise from Yepkit providing such services.
Yepkit products are not authorized for use in safety-critical applications where a failure of the Yepkit product would reasonably be expected to cause severe personal injury or death. Safety-critical applications include, without limitation, life support devices and systems, equipment or systems for the operation of nuclear facilities and weapons systems. Yepkit products are neither designed nor intended for use in military or aerospace applications or environments and for automotive applications or environment. The customer acknowledges and agrees that any such use of Yepkit products is solely at the customer's risk, and that customer is solely responsible for compliance with all legal and regulatory requirements in connection with such use.
The customer acknowledges and agrees that it is solely responsible for compliance with all legal, regulatory and safety-related requirements concerning its products and any use of Yepkit products in the customer applications, notwithstanding any applications related information or limited support that may be provided by Yepkit.
The customer acknowledges and agrees to defend, indemnify and hold harmless Yepkit and its manufacturers and distributors from and against any and all third party losses, damages, liabilities and expenses it incurs to the extent directly caused by: (i) an actual breach by a customer of the representation and warranties made under this terms and conditions or (ii) the gross negligence or willful misconduct of the customer.
To the maximum extent permitted by applicable law, in no event shall Yepkit or its manufacturers and distributors be liable to the customer or any third party for any special, collateral, indirect, punitive, incidental, consequential or exemplary damages whatsoever (including, but not limited to, damages for: loss of profits, loss of confidential or other information, business interruption, personal injury, loss of privacy, failure to meet any duty (including of good faith or of reasonable care), negligence, and any other pecuniary or other loss whatsoever) arising out of or in any way related to the use of or inability to use the products or the support services, or the provision of or failure to provide support services, or otherwise under or in connection with any provision of the agreement, regardless of whether Yepkit has been advised of the possibility of such damages. This section will survive the termination of the warranty period.
Not withstanding any damages and expenses, including attorney's fees, that the user might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability for any claim of Yepkit and any of its manufacturers and distributors, directors, officers and employees, whether in contract, tort, or any other theory of liability, arising out of or in any way related to the delivery of the product, use of or inability to use the products or the limited support services, or the provision of or failure to provide limited support services, or otherwise under or in connection with any provision of the agreement, shall be limited to the exclusive remedy for all of the foregoing consisting of replacement of the product. The foregoing limitations, exclusions, and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.
Yepkit may make changes to specifications and product descriptions at any time, without notice. The customer must not rely on the absence or characteristics of any features or instructions marked "reserved" or "undefined". Yepkit reserves these for future definition and shall have no responsibility whatsoever for conflicts or incompatibilities arising from future changes to them. The product information on the web site or materials is subject to change without notice. Do not finalize a design with this information.
Technology and the laws and limitations imposed by manufacturers and content owners are constantly changing. Thus, some of the projects described may not work, may be inconsistent with current laws or user agreements, or may damage or adversely affect some equipment.
